يدرس البحث تداخل قانون حقوق كبار المواطنين رقم (9) لسنة 2019، ولائحته التنفيذية لسنة 2021، ومرسوم الحماية من العنف الأسري لسنة 2024. ويميّز بين نطاق المستفيدين من كل نظام، وحقوق اتخاذ القرار، وواجبات الأسرة، والتدابير الوقائية والجزاءات. ويقدّم مقارنات محددة مع السعودية وإنجلترا، مع استخدام استجابتين مؤسسيتين من العمل الميداني للدكتوراه سنة 2022 بوصفهما سياقاً تاريخياً محدوداً. ويقترح تنسيق الإحالات وتوثيق الموافقة والصلح بصورة منفصلة، ودراسة مستقبلية لقياس التنفيذ.
English abstract
This article examines the interaction of Federal Law No. 9 of 2019 on the Rights of Senior Emiratis, Cabinet Resolution No. 9 of 2021, and Federal Decree-Law No. 13 of 2024 on Protection from Domestic Violence. Doctrinal analysis of the Arabic primary texts distinguishes the citizenship-defined rights scheme from the domestic-violence regime’s relationship and conduct requirements. It analyses independent decision-making, family duties, distinct criminal offences, protection-unit functions, reconciliation and urgent accommodation. Focused comparisons with Saudi Arabia and England clarify shared protections and different safeguarding entry points. Two institutional responses collected during doctoral fieldwork in 2022 provide limited historical context, rather than evidence of implementation of the 2024 regime. The article proposes coordinated referrals, separate documentation of consent and reconciliation, and monitoring of the prosecution’s 24-hour review period following receipt of an urgent shelter-referral decision. It outlines a prospective mixed-methods implementation study with explicit access, consent and confidentiality safeguards. Its contribution is a cross-statutory interpretation of the framework following the 2024 reform, distinguishing enacted requirements, proposed administrative practices and questions requiring empirical investigation.
